Welcome to ExpressEats. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Yescom Yummy Ventures Pvt. Ltd. ("Company," "we," "us," or "our").
By accessing our mobile application or website (the "Platform"), you acknowledge that you have read, understood, and agreed to be bound by these Terms. ExpressEats operates a multi-city, multi-restaurant marketplace connecting consumers with third-party vendors ("Restaurants") and independent delivery service providers ("Delivery Partners").
ExpressEats acts as a technology aggregator. We facilitate the ordering of food and beverages from various Restaurants across multiple cities.
Non-Manufacturer: We do not prepare, handle, or cook food. We are not responsible for the quality, hygiene, or preparation standards of the Restaurants.
Logistics: Delivery is provided by independent contractors. While we facilitate the connection, these partners are not employees of ExpressEats.
Eligibility: You must be at least 18 years of age and capable of entering into a legally binding contract.
Account Security: You are responsible for all activity on your account. You must notify us immediately of any unauthorized use of your credentials.
Multi-City Use: Your account is valid across all cities where ExpressEats operates. However, menu availability, pricing, and delivery fees will vary based on your specific GPS location.
Contract of Sale: When you place an order, the contract for the supply of food is between you and the Restaurant. ExpressEats is merely the facilitator.
Pricing: All prices are set by Restaurants. ExpressEats may charge additional fees, including but not limited to:
Delivery Fee: Based on distance and demand.
Platform Fee: For maintaining the technological infrastructure.
Small Order Fee: For orders below a specific threshold.
Taxes: All applicable taxes (GST, etc.) are charged based on the prevailing laws in the city of the Restaurant's operation.
Geographic Limitations: Delivery is only available within specified zones in our operating cities. If you change your location after placing an order, we may not be able to fulfill it.
Delivery Estimates: Times provided (e.g., "30 mins") are estimates. Delays due to weather, traffic, or high Restaurant volume do not entitle the user to a refund unless otherwise stated in a specific guarantee.
Verification: For certain orders (including age-restricted items where permitted by law), you may be required to provide an OTP or show valid identification to the Delivery Partner.
User Cancellation: Once an order is "Accepted" by a Restaurant, you cannot cancel it. If you cancel before acceptance, a nominal cancellation fee may apply.
Restaurant/ExpressEats Cancellation: We reserve the right to cancel orders due to unavailability of items, lack of delivery partners, or technical errors. In such cases, a full refund will be processed.
Refund Policy: Issues regarding food quality or missing items must be reported within 120 minutes of delivery. Refunds, if approved, will be credited to the original payment source or ExpressEats Wallet within 5-7 business days.
You agree not to:
Use the Platform for any fraudulent or "cash-on-delivery" scams.
Harass, abuse, or use profanity toward Delivery Partners or Customer Support.
Provide false addresses or contact information.
Attempt to scrape data or reverse-engineer the Platform.
No Warranty: The Platform is provided "as is." We do not warrant that the service will be uninterrupted or error-free.
Liability Cap: To the maximum extent permitted by law, ExpressEats’ total liability for any claim shall not exceed the value of the order placed by the user.
Indemnity: You agree to indemnify ExpressEats against any claims arising from your breach of these Terms or your violation of any law or third-party rights.
These Terms shall be governed by and construed in accordance with the laws of India.
Exclusive Jurisdiction: Any disputes, claims, or legal proceedings arising out of or in connection with these Terms or the use of the ExpressEats Platform shall be subject to the exclusive jurisdiction of the courts located in Patna, Bihar, India.
ExpressEats reserves the right to add, modify, or discontinue any city operations or features at our discretion. We may update these Terms from time to time, and the "Effective Date" at the top will reflect the latest revision.
